When should I call a CDLP versus only talking to my attorney?

Call when the house or a mortgage is on the table: keeping the marital home, buying the other person out, getting a name off a loan, assuming the current mortgage, or purchasing a new home during or after the case. Attorneys handle the legal structure. A CDLP handles the lender’s rules, timing, and what is actually financeable. The two conversations work best together, especially before settlement language is locked in.

What is a buyout refinance?

A buyout refinance is a new loan in one person’s name that pays off the existing mortgage and, when the numbers work, funds the equity the other spouse is due under the settlement. It is how many people keep the house without leaving a former spouse on the debt. Qualification is based on the remaining borrower’s income, credit, debts, and the property — not on the fact of the divorce alone. Joe can run those numbers early so you know whether keeping the home is realistic before you commit to it in writing.

How do I get a spouse off the mortgage?

If your goal is to be free of the loan — or to keep the house without the other person remaining liable — you need a lender-approved path, not only a court order.

A consult is for people who need a clear read on the mortgage before, or instead of, applying for a new one. Typical work includes reviewing the current loan, whether an assumption is possible, what a buyout would take, how title and liability differ, and what language in a settlement can create problems later. You leave with a practical picture you can take back to your attorney — not a sales pitch for a loan you do not need.

Will this hurt my credit?

A conversation and a consult do not affect your credit. A pre-approval or application may involve a credit pull, which Joe will explain before it happens. Leaving a joint mortgage in place after divorce can affect both people for years, because the loan still reports. Getting the liability structured correctly is often as important as the rate.

There is no charge to start a conversation. If you pursue a purchase or refinance, compensation is disclosed as part of the loan process, the same as any other mortgage. The useful window is often before settlement terms are drafted — when you still have room to choose between keeping the house, selling, assuming, or buying something else. Mid-divorce and post-decree work is still common; it is simply more constrained. If a deadline is already in a decree, say so in the form so Joe can triage accordingly.
